Filing the Forms to Make Your Organization Legal
Articles of Incorporation
Each state has different requirements and forms to fill out to make your organization a legal entity. I will work with your organization to ensure that these forms are filled out correctly and have the necessary language so that your organization can apply for federal tax exempt status through the IRS. Just becoming a nonprofit in your state does not mean you will be the requirements for tax exempt status federal. Putting the right information into your organizing document can make all the difference.
Bylaws
I will create bylaws for your organization if you do not already have bylaws. My philosophy is to make sure you have bylaws that are strong from both a legal and governance standpoint. The bylaws should be easy to read and follow for your board members so your board members can follow the bylaws as well as protecting your agency legally.
Conflict of Interest Policy
The IRS prefers organizations with conflicts of interest policies and it is the best practice in the industry. I will work with you to create a conflict of interest policy that will work for the IRS and help protect your organization's public perception from potential issues.
IRS Tax Exemption
I will file the forms and attachments to achieve nonprofit status, 501(c)3, 501(c)4, etc. I will work with your organization to gather the necessary information to make sure you are approved. If you do not have an EIN number, I will get that for you as well.
State Tax Exemption
Every state has a different approach to approving and monitoring nonprofit organizations. I can talk to you about your state's requirements and file the appropriate documents to get your state exemption. Just because you have a federal tax exemption from the IRS does not automatically give you a state exemption as well.
